Elections rule amends trigger new rows

 

 

Pakistan Peoples Party has rejected the amendment in the Presidential Election Rules as unconstitutional and illegal. In a statement on Sunday, spokesperson of the Party former Senator Farhatullah Babar said that many would regard the amendment as rigging the forthcoming Presidential elections that will have far reaching political and constitutional repercussions


The Election Commission of Pakistan (ECP) yesterday arbitrarily changed the rules barring the Returning Officer from rejecting the nomination papers of a candidate under Article 63 of the Constituion. Constitutional amendments can only be made by the Parliament. Article 63 pertains to the eligibility of a person who can contest to become a member of Parliament and President of Pakistan. It gives grounds for disqualification of a candidate for Parliament and President


As General Musharraf is disqualified from contesting for President, he has prevailed upon the Election Commission to arbitrarily and illegally tamper with the Constitution of Pakistan, he said. In fact the ECP attempt to arbitrarily amend the constitution of Pakistan amounts to subversion of the Constitution


The spokesperson said that instead of negotiating a Constitutional package that could take the country towards stability, security and democracy, General Musharraf regime had decided to consolidate its rule through illegal and unconstitutional means that can only deepen the crisis in the country by paving the way for a fresh confrontation with the Superior Judiciary and the people of Pakistan


Doubt has been raised whether present ECP can hold fair elections or is a party to the Presidency’s partisan political agenda. The All Parties Conference in London called for the reconstitution of the Election Commission. The PPP demands that the amendments made in the Election Rules be immediately withdrawn, he said


Secretary Election Commission has said the Presidential Election Rules have been amended under the Supreme Court’s 2002 and 2005 decisions and a notification to this effect has been issued while the text will be released tomorrow. Article 63 of the Constitution in the light of these Supreme Court decisions no longer applies to the president, Secretary Election Commission Kunwar Irshad told to a private channel

He said the Presidential Election Rules have been amended, which issues with the approval of the president. He said all institutions under Articles 189 and 190 of the constitution are bound to the decision of the Supreme Court. The Chief Election Commissioner will announce the schedule of presidential election within next two to three days, he said. All conditions that apply to a member of parliament also apply to a candidate of presidential election, he added

President Mutahidda Majlise-e-Amal Sunday said that Election Commission of Pakistan should not issue controversial notification and Dr Sher Afgan, Federal Minister for Parliamentary Affair should not strive to make election commission as an controversial body
